Job Description:

The Litigation Attorney is responsible for direct handling of New York No-Fault litigation matters and to a lesser extent third party litigation referred from the local New York Esurance Claims Office from inception through trial. This position involves determining, conducting and reporting any and all appropriate legal action to best protect the interests of the carrier and its insureds. This position is responsible for the legal direction of each case from inception to conclusion and will involve representing the carrier and its insureds in court. The candidate must demonstrate a willingness to continually enhance abilities and professional competence by displaying commitment to and interest in self-education and continuing education. This position reports directly to the Managing Attorney of the Brooklyn Staff Counsel Office.

Responsibilities Include:

• Direct handling of all aspects of New York No-Fault litigation matters on behalf of Esurance and its insureds referred by the New York Esurance Claims Office from inception through trial

• While a significant percentage of the workload will involve No-Fault litigation, to a lesser degree responsibilities will include handling all aspects of third party litigation matters as well

• Prepare and handle cases for trial involving a wide variety of issues

• Report to and interact with the New York Esurance Claims Office with respect to case developments pursuant to the company’s litigation guidelines and established office procedures

• Promote positive working relations and communications between Staff Counsel and Esurance claims personnel to facilitate efficient handling of No-Fault and third party matters

• In addition to preparing initial pleadings and discovery demands/responses, responsibilities include all aspects of motion practice, attending depositions and Examinations Under Oath, and representing the carrier and its insureds in Court

Job Requirements:

• Law Degree from an ABA accredited school or university

• Active license in good standing with New York State Office of Court Administration

• 1-3 years of direct experience handling New York No-Fault defense litigation with some experience handling third party litigation

• Trial experience preferred although not required

• Staff counsel experience is a plus

• Substantial knowledge of NY legal system and NY law relevant to No-Fault and general personal injury insurance defense litigation

• Knowledge of local docketing/calendaring systems

• Excellent written, verbal and advocacy skills; ability to effectively and timely navigate a lawsuit from inception through trial

• Excellent organizational skills

• Strong professional ethics, reliability and accountability required
